Change to mining policy

The removal of Clause 12AA of the Mining SEPP is a very welcome development. It will reinstate an approach that has been accepted across Australia of ecologically sustainable development.
The introduction in November 2013 of the clause stating that the significance of a mining resource is to be the consent authority’s principal consideration under Part 3 of the Mining SEPP was a step backward for sustainable management of our natural resources and completely at odds with international environmental law policy.
As a former teacher of environmental law at UNSW, I can say that my students were very upset about this provision, which made a mockery of review processes available in the NSW Land and Environment Court.
The government's removal of Clause 12AA will go a long way towards regaining credibility with the community at large.
